Subscription Terms
Thank you for subscribing to our NewsNow Premium news discovery subscription service ("Service"). These Terms apply to the Service, which is offered by us via our website at www.NewsNow.co.uk, our website at www.NewsNow.com and (as far as relevant) any other websites, apps and online services operated by us (collectively and individually, the "Site").
References in these Terms to "NewsNow", "we", "us" or "our" are to NewsNow Publishing Limited and, where the context allows, include any of our affiliates.
Our Legal Notice also applies to your use of the Service and forms part of these Terms. Please also note our Privacy Policy and Cookie Policy, which explain how we process personal data and set cookies in connection with the Site and the Service.
If you do not wish to use the Service on the basis set out below, please do not subscribe for it.
1. Subscription benefits
Subscribing for our Service as a regular subscriber gives you the following benefits:
You can use our Site without any ads.
When you are signed in to your NewsNow account, you will not be shown any third-party display advertising on the Site (other than our “classifieds” sub-sections of the Site).
Please note that house ads (i.e. promotions for our own services, such as NewsNow classifieds) and non-display ads (such as text links) may still be shown on the Site.
You may still see ads on third-party sites that we link to, which are beyond our control.
You will get a faster refresh rate on article feeds on the site
You will also be entitled to any additional benefits that we may, at our discretion, offer from time to time to our regular subscribers, such as enhanced Site functionality, discounted merchandise or invitation-only online events.
We may, from time to time, offer different subscription tiers with extra benefits beyond those described above. Any benefits that are specific to any such tier will be set out in the separate terms that apply to that tier, which will form part of these Terms. Details of how to make use of the benefits will be provided in any relevant messages that we send you about those. The extra benefits and the associated terms may vary from tier to tier. Please see section 5 below for further details of potential variations.
Alternatively, you can still use our Site for free while seeing personalised ads that are relevant to you.
All use that you make of any Service benefits that you access on the Site will be governed by these Terms. Any use that you make of any third-party services in connection with your Service subscription will be governed by each relevant third party’s terms and conditions, including any third-party limitations on liability or other restrictions.
In addition to these Terms, special terms may apply to any special offer (such as an upgrade, discount or additional feature) that you select as part of, or during, your Service subscription, and those special terms (including any limitation of period during which an offered benefit would apply) will form part of these Terms (while prevailing over these Terms in relation to the special offer, to the extent of any inconsistency). Any such special terms will be provided to you when you select the special offer. We reserve the right to modify, limit, restrict or terminate special offers at any time before purchase, without notice and in our sole discretion.
We may also offer alternative subscription plans from time to time, such as special plans with differing conditions and limitations. Any materially different terms from those described in these Terms will be provided to you before purchase and will form part of these Terms (while prevailing over these Terms in relation to the alternative plan, to the extent of any inconsistency).
Unless otherwise stated in any of our additional terms, all the benefits of your Service subscription are personal to you and for your non-commercial use and non-transferable, and must not be shared with others.
2. Subscribing for the Service
To be eligible to subscribe for the Service, you must (unless otherwise stated in additional terms):
be resident in the UK; and
have attained the age of majority in your jurisdiction of residence (which is 18 years of age for UK purposes).
We reserve the right to add other territories and to exclude territories from time to time, and to limit or vary Service benefits or special offers made available in any territory.
To subscribe for the Service, you will first need to create a NewsNow Basic account by registering at https://www.newsnow.co.uk/h/register/. You will also need to comply with the requirements set out in the “NewsNow account” section of our Legal Notice.
We will usually send you messages about your subscription by email.
If we accept your order, we shall send you a notice of acceptance by email, which will form a binding subscription contract between you and us.
Your subscription will begin on the start date confirmed by us by email or text. You can access the Service features immediately on activation of your subscription.
Unless you sign up for an introductory period (which will last as long as stated in the offer terms), your subscription will continue for an initial period of one month. It will then automatically renew for successive periods of one month, unless cancelled in accordance with these Terms.
You will be responsible for maintaining any third-party software and connectivity that your device(s) require to access wireless and internet services generally, and you are solely responsible for all related charges from your software licensors and wireless and internet providers. We are not liable to you if any Service benefits are or become unavailable to you due to any failure in such software or connectivity. If you cannot access any Service benefit for any reason that you believe is our responsibility, please contact us (see section 9 below).
3. Pricing and payment
Pricing
The price of your subscription (inclusive of any applicable VAT) will be confirmed when you place your order. It may vary from time to time per subscription period and/or by territory. You will pay the initial price at the start of the subscription period and at the rate notified to you when you first buy your subscription.
On a renewal of your subscription, you will pay the new package price (inclusive of any applicable VAT) at the start of the renewal period and at the rate notified to you in your renewal reminder message.
On acceptance of a special offer, any relevant additional charges (inclusive of any applicable VAT) and related payment terms will be confirmed to you on the relevant order page. Those charges may vary as well from time to time, and any then-current charge will be notified to you before you place the order.
We will aim to state correct prices for the Service and for Service benefits and to provide accurate descriptions of those, but we do not warrant that the pricing or specification of those on the Site is complete, accurate, reliable, current or error-free. If the correct price of the Service or a Service benefit is in fact higher than our stated price or the specification of the Service or any Service benefit is misdescribed, we reserve the right at our discretion to refuse or cancel your order at our discretion. If we accept and process your order where a pricing or specification error is obvious and unmistakable and could reasonably have been recognised by you as a mispricing or misdescription, we may end the subscription and refund any amounts you have paid.
Payment
To pay for a subscription or special offer, you can pay using any of the payment methods that are accepted by us (or our payment-services provider) at the time of payment.
Your agreement with your payment-method provider applies to your use of your chosen payment method, and you should refer to that agreement (and not these Terms) for details of your rights and obligations as a user of the payment method. For example: (a) currency exchange rates may fluctuate, and you may be charged conversion fees by your payment-method provider; (b) your provider may charge you certain other fees relating to the processing of your payment method; and (c) local tax charges may vary, depending on the payment method.
By submitting payment details to us or our payment-services provider, you confirm that you are entitled to make a purchase from us using that payment method, and you will notify us of any changes to the payment information. Please note that YOU ARE SOLELY RESPONSIBLE FOR PAYING ANY UNAUTHORISED AMOUNTS BILLED TO YOUR PAYMENT METHOD BY A THIRD PARTY.
In the event that your default payment method is declined or no longer available, you authorise us to charge any other payment method that you have authorised for use on your account with us. If a payment is not successfully settled for any reason, and you do not cancel your order with us, we may: (a) suspend your subscription until we have successfully charged an alternative valid payment method; (b) if and as far as permitted by law: (i) on giving you notice, terminate the Service contract affected by the failure; (ii) charge you for any amount due for the remainder of your then-current subscription period; and/or (iii) take any step that we consider appropriate to recover any related loss.
If your subscription has ended and you would like to re-subscribe for the Service, we may require you to pay any amount still owed to us for your previous subscription.
We reserve the right to use (or to authorise our payment-services provider to use) third-party checking services to confirm current expiry dates on your payment methods.
Subscription fees will be billed in advance on a recurring basis, by our payment provider.
By subscribing for the Service, you authorise us to charge your chosen payment method automatically for the subscription fees. Failure to pay may result in immediate suspension or termination of your subscription.
Please note that we will not be required to pay you any refund if, for any reason other than our or our agents’ default, you decide not to make use of any one or more of the Service benefits.
4. Your cancellation rights
Cancelling within the first 14 days
You may cancel an order for a Service subscription within 14 days from our acceptance of your order for it. We will then refund any related payment received from you, using the payment method you used to buy your subscription. You will not be entitled to a refund of your initial payment if you cancel after the end of the 14-day period.
If you decide to cancel within the14-day period, you can do so from your NewsNow account page or send an email to us at site_enquiry@NewsNow.co.uk from your registered email address, informing us that you would like to cancel or including a completed version of this form:
To: Customer Service, NewsNow
I am writing to inform you that I am cancelling my subscription to your subscription service.
Ordered on: [insert the subscription order date]
My full name:
My email address:
Date: If you cancel within that 14-day period, your access to Service benefits will end at once and you will lose all ongoing Service subscription benefits with effect from the cancellation date.
Terminating your subscription after the initial 14-day period
After that initial 14-day period, you can, at any time give us notice of your wish to terminate your subscription with effect from the end of the initial subscription period. You can do so from your NewsNow account page or send an email to us at site_enquiry@NewsNow.co.uk to that effect.
Cancelling a Service subscription renewal
Around ten working days, and then around five working days, before the date falling one month before your subscription is due for renewal, we will email you with a reminder about the renewal and stating any variations in package, pricing and/or terms that we propose to apply for the renewal period. At any time during the period starting on your receipt of that first email and ending 14 days after the renewal date, you will be entitled to cancel the renewal. You can do so from your NewsNow account page or send an email to us at site_enquiry@NewsNow.co.uk within that period, including a completed cancellation notice, which may be based on the form of cancellation set out above in this section 4.
Please note that, if you do not provide us with due notice of cancellation within such cancellation period (or an earlier notice of cancellation that complies with the terms of this section 4), your subscription will automatically continue until the end of the renewal period and you will be required to make your payment for such renewal period at the start of the renewal period. Your renewal payment date will be set out in your renewal reminder.
Terminating your subscription after a renewal cancellation period
Thereafter, you can, at any time, give us notice of your wish to cancel your subscription with effect from the end of the relevant renewal period. To do so, please send an email to us at site_enquiry@NewsNow.co.uk to that effect.
Renewal period(s)
The process described above will be repeated in an equivalent way for each successive renewal period of your subscription.
Cancelling a special offer
If you place an order with us for a paid special offer (i.e. separately from your subscription package), you will be entitled to cancel the order within 14 days from our acceptance of your order. To do so, please send an email to us at site_enquiry@NewsNow.co.uk within that 14-day period, including a completed notice of cancellation, which may be based on the form of cancellation set out above in this section 4. We will then refund any related payment received from you, using the payment method you used to place the order.
Please also note that if you cancel a subscription, you will still be required to pay any charge that you have incurred for any separate special offer (unless you have separately and duly cancelled your order for that special offer).
Partial refund on a cancellation
Despite anything implied to the contrary above, if you cancel within any of the cancellation periods described in this section 4 and you have already started to make use of any of the Service benefits before you cancel, we reserve the right to deduct from your refund a proportionate amount up to the value of the used Service benefits.
Your other legal rights
You may have various other legal rights as a consumer by law, and nothing in these Terms is meant to affect any such rights. For example, where English law applies, where we supply you with a service under these Terms, you can generally ask us to repeat or fix the service if it is not carried out with reasonable care and skill or obtain a refund if we cannot fix it. For more detailed information on your legal rights as a consumer, please visit the Citizens Advice website www.adviceguide.org.uk or call them on the relevant number set in their contact details.
5. Our variation, termination and suspension rights
Variation
Subject to applicable law, we reserve the right from time to time, in our discretion and (as far as reasonably practicable) on giving you at least one month’s notice:
(a) to vary your subscription price and/or any additional charges; and/or
(b) to make a substantial variation to your subscription benefits, including by discontinuing, replacing or otherwise varying any aspect(s) of the subscription or of any subscription tier (although a variation will not be considered substantial for this purpose if we replace those subscription benefits with other benefits of comparable quality or if the discontinued or otherwise varied aspect(s) are not material in the context of the subscription benefits as a whole).
If you are adversely affected by such a variation, you may terminate your Service subscription on giving us notice of termination in your NewsNow account or via email to us at site_enquiry@NewsNow.co.uk at any time during that notice period (or if, due to reasonable impracticability, we cannot give you notice, at any time during the period of one month from the date of variation). In such case you will be entitled to request a proportionate refund from us for the remainder of the then-current subscription period.
Subject to applicable law, we also reserve the right to modify any Service-related feature: (a) to reflect changes in relevant laws and regulatory requirements; and/or (b) to implement minor technical adjustments and improvements that would not affect your use of the feature.
Subject to applicable law, we also reserve the right to change these Terms from time to time, including in order:
to ensure our compliance with any relevant laws and regulations;
to make improvements to your Service subscription experience; and/or
to vary our terms of purchase, pricing, billing methods, access and/or use of Service benefit(s) in any other respects (in which case the new terms shall apply to any new purchases made after the terms have been varied).
We will notify you of any such modified terms by posting the revised version on the Site. You are encouraged to check the terms of such revised versions. If the changes are significant, we will provide a more prominent notice and/or email notification of the changes. Each time you make a Service-related purchase, the version of these Terms in force at that time will apply to that purchase. Each version of these Terms will be identified at the top of the page by its effective date, and we will also keep previous versions of these Terms in an archive for your review. If you use the Service after the date on which these Terms have been changed, we will treat such use as your consent to the revised Terms.
Termination and suspension
When you register for a Service subscription, we may check your name and address against credit-reference and fraud-prevention databases. If we decline your order, we will terminate your subscription and refund any related payment that you have made to us.
We may also, at our sole discretion, terminate or suspend your subscription at any time if we have serious grounds on which to terminate or suspend it, such as for your non-payment of any amount due to us or for material breach of these Terms or of any of our relevant additional terms.
6. Limitations of our liability
If our supply of any Service benefits is delayed by any circumstance beyond our reasonable control, then we shall take steps to minimise the effect of the delay and we shall not be liable for delays caused by such circumstance, but if there is a risk of substantial delay, you may contact us to end the contract and to receive a refund for any Service benefits that you have paid for but not received.
If we fail to comply with these Terms, we are liable for any loss or damage you suffer as far as that is a foreseeable result of our breach of these Terms or our failing to use reasonable care and skill. Loss or damage is foreseeable if it is obvious that it will happen or if, at the time the contract was made, we and you both knew that it might happen.
Except as provided above, our liability in relation to any purchase or use of a Service subscription or Service-related benefit is, to the fullest extent permitted by law, limited in accordance with the limitations of liability set out in the “Limitations of liability” section of our Legal Notice.
Further, we do not make any warranties about Service uptime, availability of specific Service features and/or links to specific third-party publications.
IN ANY EVENT, NOTHING IN THESE TERMS WILL EXCLUDE OR RESTRICT OUR LIABILITY IN RESPECT OF YOUR RIGHTS AS A CONSUMER UNDER LAW, FOR DEATH OR PERSONAL INJURY RESULTING FROM OUR NEGLIGENCE, FRAUDULENT MISREPRESENTATION OR FOR ANY OTHER LIABILITY THAT CANNOT BE LIMITED OR EXCLUDED BY APPLICABLE LAW.
